Advertisements
Presleynews.com is not responsible for any of your participations in or correspondence with promotions of advertisers, as they are solely between you and such party. Presleynews.com is not liable nor responsible for any damage or loss of any sort incurred, in any form, as a result of such dealings or as the result of the presence of advertisers or advertisements on the site.

Disputes
Any dispute, claim or controversy arising out of, or relating in any way, to your usage of service, the service itself and/or the site or these terms of use, must be commenced within one week of the relevant events, to the extent permitted by applicable law. A dispute is commenced if it is filed in an arbitration, or if the dispute in non-arbitrable a court with jurisdiction, during the one week period. You waive the right to pursue any dispute, claim and/or controversy that is not filed within one week and any right you or we may have had to pursue any dispute, controversy or claim in any form is permanently barred. Presleynews.com officers, directors and employees shall not be held liable for any direct, indirect, consequential or special liability arising out of or in any way related to your use of this site. You agree to defend Presleynews.com, its affiliates and their respective staff from and against all expenses and claims, including attorneys‘ fees, arising out of the usage of the site by your account. Presleynews.com reserves the right to take over the exclusive defense of any claim for which we are entitled to indemnification. You shall provide, in such event, Presleynews.com with such cooperation as is requested by Presleynews.com. You hereby indemnify to the fullest extent Presleynews.com from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these terms. Any arbitration under these terms shall take place on an individual basis – class arbitrations and class actions are not permitted. Unless limited by these terms, arbitrators can award the same damages and relief that a court can award and disputes are resolved through binding arbitration or small claims court instead of in courts of general jurisdiction. Arbitrators and arbitration place is chosen by Presleynews.com. All disputes in connection with your access to, and/or use of the site, and/or the provision of content, services, and/or technology on or through the site is to be governed in accordance with the laws of a state that Presleynews.com chooses applicable to contracts made, entered into and performed entirely therein, without giving effect to its conflict of laws provisions, except to the extent that law is inconsistent with or preempted by federal law. For all non-arbitral claims under this agreement that action shall be brought up in a state of Presleynews.com choosing. The party that intends to seek arbitration must send to the other a written Notice of Dispute and that notice must describe the basis and nature of the dispute or claim as well as set forth the specific relief sought. You or we may begin an arbitration proceeding within 5 days if you and we do not reach an agreement how to resolve the dispute. The amount of any settlement offer made by you or us shall not be disclosed to the arbitrator until after the arbitrator determines the amount, if any, to which us or you are entitled. You agree that each party may bring claims against the other only in your or our individual capacity, and not as a class member or plaintiff in any purported class, representative, or private attorney general proceeding. The arbitrator may award declaratory or injunctive relief only in favor of the individual party seeking relief and only to the extent necessary to provide relief warranted by that individual claim of that party.
